Unmarried mothers and fathers are protected by Florida Law, too. Specifically, unwed parents are entitled to significant and meaningful contact with the child(ren), support, a concrete time-sharing schedule, and so forth. However, for the father to have enforceable rights, a Court must enter an order establishing paternity first. Some issues include:
One parent not allowing the other to have significant time with the child either “just because” or because paternity had not been established by a Court.
One party demanding money in exchange for time with the child(ren).
Situations where one parent is alienating the children or refusing to allow the other parent to have significant and meaningful time with the children.
Is a DNA test required and, if so, who will pay for it?
