Living Together Agreements

You should definitely consider a Relationship Agreement if:

You are/have remarried.  In a subsequent marriage, your legal and financial concerns are often very different than in your first marriage:  you may have children from a previous marriage that you want to provide for; you may own a home or other assets; you may not want to endure the legal expense and wrangling or “another divorce,” etc. A prenuptial agreement can ensure your wishes are honored.

You are/will be living with someone in a romantic- or roommate-type relationship.  Typically, when a romantic- or roommate-type living together arrangement ends, one person moves out leaving the other person/people stuck with the bills:  rent/mortgage, electric, cable, telephone, HOA dues, and the like.  Unless you plan ahead, you will find yourself with two unpleasant choices:  pay for everything yourself or pay for a lawyer and sue.

You are the owner of a business. Without a Relationship Agreement, when your relationship ends, your spouse/partner could end up co-owning your business, getting a percentage of the growth in your business, forcing the sale of your business, and so forth. In this case, either a postnuptial or prenuptial agreement can protect your business.
